A federal appeals court in Washington has given the green light for a lawsuit filed by a group of U.S. Capitol Police officers against former President Donald Trump to proceed. The court rejected Trump's claim of absolute immunity from civil lawsuits related to the January 6, 2021, attack on the U.S. Capitol. The three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit based its decision on a prior ruling in a separate case brought by Capitol Police officers and House Democrats. In their opinion, the judges stated that Trump's argument for immunity "fails" and that his alleged actions surrounding the January 6 attack do not fall within the official functions of the presidency. The lawsuit, initiated by seven Capitol Police officers in August 2021, accuses Trump and others, including members of extremist groups and a Trump ally, of "unlawful actions" that resulted in physical and emotional injuries during the riot. The former president's request to dismiss the case was previously rejected by a federal District Court in Washington, which ruled that Trump is not entitled to broad immunity from civil lawsuits in connection to the January 6 riot. The D.C. Circuit upheld this finding and dismissed Trump's argument that he was acting within the official capacity of the presidency during the events in question. Trump has the option to seek a review of the rulings in both cases before the full D.C. Circuit or the U.S. Supreme Court. The former president has consistently argued for dismissal based on presidential immunity, though recent decisions have not favoured his stance. Additionally, Trump faces a criminal case in Washington, D.C., for alleged efforts to obstruct the transfer of presidential power after the 2020 election. The D.C. Circuit has expedited the case, with arguments on the immunity issue scheduled for January 9.
