Supreme Court stays Allahabad HC's order for court-monitored survey of Shahi Idgah near Krishna Janmabhoomi temple in Mathura

In a recent development, the Supreme Court temporarily suspended the implementation of the Allahabad High Court's order directing the appointment of a local commissioner for surveying the Shahi Idgah mosque premises near the Krishna Janmabhoomi temple in Mathura. Justices Sanjiv Khanna and Dipankar Datta halted the December 14, 2023, order, which had approved the appointment, emphasizing the need for specificity in applications for court commissioner appointments. The apex court stated that the application made before the high court was vague and should not have formed the basis for appointing a local commissioner.

While issuing a notice to Hindu bodies represented by senior advocate Shyam Divan, including Bhagwan Shri Krishna Virajman, the Supreme Court clarified that the stay puts the survey's implementation on hold pending further judicial proceedings. The court highlighted the importance of clear and specific applications to avoid broad mandates for interpretation by the court.

The plea before the Supreme Court was filed by the Committee of Management, Trust Shahi Masjid Idgah, challenging the high court's decision to allow the survey. The mosque committee argued that the high court should have first addressed its petition seeking dismissal of the objection before considering other miscellaneous applications in the suit. The committee contended that the lawsuit is precluded by the Places of Worship (Special Provisions) Act, 1991, which restricts alterations to the character of religious places.

The Supreme Court's decision temporarily halts the survey process, allowing for further legal proceedings while affirming that the Allahabad High Court can continue with the overall case.

भगवान श्री कृष्ण विराजमान सहित वरिष्ठ अधिवक्ता श्याम दीवान द्वारा प्रतिनिधित्व किए गए हिंदू निकायों को नोटिस जारी करते हुए, सुप्रीम कोर्ट ने स्पष्ट किया कि रोक आगे की न्यायिक कार्यवाही लंबित रहने तक सर्वेक्षण के कार्यान्वयन को रोक देती है। अदालत ने व्याख्या के लिए व्यापक आदेशों से बचने के लिए स्पष्ट और विशिष्ट अनुप्रयोगों के महत्व पर प्रकाश डाला।

सर्वोच्च न्यायालय के समक्ष याचिका प्रबंधन समिति, ट्रस्ट शाही मस्जिद ईदगाह द्वारा दायर की गई थी, जिसमें सर्वेक्षण की अनुमति देने के उच्च न्यायालय के फैसले को चुनौती दी गई थी। मस्जिद समिति ने तर्क दिया कि उच्च न्यायालय को मुकदमे में अन्य विविध आवेदनों पर विचार करने से पहले आपत्ति को खारिज करने की मांग करने वाली अपनी याचिका को संबोधित करना चाहिए था। समिति ने तर्क दिया कि मुकदमा पूजा स्थल (विशेष प्रावधान) अधिनियम, 1991 द्वारा खारिज किया जाता है, जो धार्मिक स्थानों के चरित्र में बदलाव को प्रतिबंधित करता है।

सुप्रीम कोर्ट के फैसले ने सर्वेक्षण प्रक्रिया को अस्थायी रूप से रोक दिया, जिससे आगे की कानूनी कार्यवाही की अनुमति मिल गई, साथ ही यह पुष्टि की गई कि इलाहाबाद उच्च न्यायालय समग्र मामले को जारी रख सकता है।
