On Wednesday, the Delhi High Court declined to grant interim relief to Delhi Chief Minister Arvind Kejriwal, who is currently in the custody of the Enforcement Directorate (ED). Instead, the court issued notices regarding Kejriwal's plea and scheduled further hearings for April 3. A bench led by Justice Swarana Kanta Sharma served a notice to the ED in response to Kejriwal's plea, which seeks his immediate release and challenges the legality of his arrest and remand.
The court instructed the ED to respond by April 2. Senior advocate AM Singhvi, representing Kejriwal, contended that no response from the ED was necessary, but the court disagreed. It emphasized its obligation to hear both parties fairly, adhering to the principles of natural justice. The court deemed the ED's response essential for a just decision in the case. It stated, "Thus, considering the issues raised in this petition, the respondent must be allowed to respond, as this constitutes effective representation.
Denying this opportunity would violate the principles of natural justice, particularly the audi alteram partem principle, which applies to both parties." Meanwhile, the ED is expected to present Kejriwal in court on Thursday as his current remand expires. Kejriwal was arrested by the ED last Thursday in connection with the Delhi liquor probe, with the agency seeking a six-day custody starting from March 22. The ED may request an extension of Kejriwal's custodial remand or seek court orders for his transfer to judicial custody.
