Google Settles $5 Billion Privacy Lawsuit Over Tracking People Using 'Incognito Mode'

Google has agreed to resolve a $5 billion privacy lawsuit that alleged the company engaged in spying on individuals utilizing the "incognito" mode in its Chrome browser, as well as similar "private" modes in other browsers, to monitor their internet activities.

The class-action lawsuit, initiated in 2020, contended that Google misled users by creating the impression that it would not track their internet actions while in incognito mode. The argument asserted that Google's advertising technologies and other methods continued to gather details about users' site visits and activities, despite their adoption of ostensibly "private" browsing.

Plaintiffs further claimed that Google's actions amassed an "unaccountable trove of information" about users who believed they had taken measures to safeguard their privacy. The settlement, reached on Thursday, is still pending approval from a federal judge. Although the terms were not disclosed, the initial lawsuit sought $5 billion on behalf of users. The plaintiffs' attorneys anticipate presenting the court with a final settlement agreement by February 24. Google has not provided an immediate response to requests for comment on the settlement.
