Heavy costs should be imposed: Delhi HC on plea to remove Arvind Kejriwal as CM.

The plea submitted by former Aam Aadmi Party MLA Sandeep Kumar, requesting the removal of Arvind Kejriwal from his position as Chief Minister of Delhi, has been scheduled for a hearing on April 10 by the Delhi High Court. Kejriwal is currently in judicial custody due to an ED case related to the excise policy.

Justice Subramonium Prasad emphasized the seriousness of the matter and questioned Kumar about the validity of issuing a writ of quo warranto against Kejriwal. The court noted that similar petitions had previously been addressed by a division bench led by Acting Chief Justice Manmohan and insisted that this matter be listed before the same bench.

This marks the third attempt to seek such action, with previous pleas having been dismissed by a division bench led by Acting Chief Justice Manmohan.

Kumar clarifies that he has approached the Court individually, not as a public interest litigation (PIL), and claims to be a founding member of the Aam Aadmi Party and a social worker. The plea requests the issuance of a writ of quo warranto against Kejriwal, compelling him to demonstrate his authority, qualifications, and title to hold the position of Chief Minister of Delhi.

Additionally, the plea seeks Kejriwal's removal from office, with or without retrospective effect, following an inquiry. Kumar argues that as a voter in the Delhi Assembly Election, he is personally affected by having a Chief Minister who is deemed incapable of fulfilling his duties, especially considering the constitutional provision that a Chief Minister cannot function from custody or prison.

The plea asserts that every citizen and voter has a constitutional right to a government following the Constitution, emphasizing the importance of upholding this right. Kejriwal was arrested on March 21 and subsequently remanded to ED custody until April 15.
